Welcome to Egg Injections.

These Terms and Conditions (“Terms”) form an agreement between you and Egg Injections LLC (“Egg Injections,” “we,” “us,” or “our”) and govern your access to and use of egginjections.com, Egg Accounts, Egg Injections games including Egg Injections (The Game!), and other games, applications, websites, features, and online services that link to these Terms (collectively, the “Services”).

By creating an Egg Account, accessing or using the Services, or otherwise agreeing to these Terms, you agree to be bound by them.

If you do not agree to these Terms, do not use the Services.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction if higher, and have the legal capacity to enter into these Terms.

You may not create or use an Egg Account if you do not meet these eligibility requirements.

If you use a Service on behalf of an organization, you represent that you are authorized to accept these Terms on behalf of that organization.

2. Egg Accounts

Certain Services require an Egg Account.

An Egg Account may act as a single account used to access multiple Egg Injections games and Services.

You agree to:

  • Provide accurate account information;
  • Maintain the security of your account credentials;
  • Not knowingly allow unauthorized persons to access your account;
  • Notify us if you believe your account has been compromised; and
  • Use your account only in accordance with these Terms.

You are responsible for activity conducted through your Egg Account to the extent permitted by law.

We may use reasonable security procedures to confirm account ownership before making certain changes, restoring access, or responding to requests involving an account.

Unless we expressly permit it, Egg Accounts may not be sold, rented, transferred, or commercially shared.

Separate Game Data

Using one Egg Account across multiple games does not mean that all game information is shared between those games.

Unless expressly stated otherwise:

  • Progress in one game does not transfer to another game;
  • Virtual currency purchased or earned in one game cannot be used in another game;
  • Subscriptions apply only to the game, Service, or benefits identified when purchased;
  • Virtual items do not transfer between games; and
  • Purchasing something in one Service does not give you ownership of or access to content in another Service.

3. License to Use the Services

Subject to these Terms, Egg Injections grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Services for personal entertainment and other purposes expressly permitted by us.

You do not purchase ownership of the underlying game software, artwork, characters, systems, source code, trademarks, or other intellectual property merely by purchasing access, virtual currency, items, or a subscription.

Except where permitted by law or expressly authorized by us, you may not reproduce, sell, commercially exploit, modify, distribute, reverse engineer, interfere with, or create unauthorized derivative services from our software or Services.

Nothing in this section is intended to restrict rights that cannot lawfully be restricted.

4. Acceptable Use and Game Rules

You agree not to:

  • Violate applicable law;
  • Gain or attempt to gain unauthorized access to an account, database, server, or Service;
  • Circumvent security or access controls;
  • Use cheats, unauthorized automation, bots, exploits, or other tools to obtain an unfair advantage;
  • Intentionally exploit a bug or vulnerability instead of reporting it where exploitation could harm the Service or other users;
  • Manipulate purchases, virtual currency, rewards, rankings, matchmaking, or game systems through fraud or unauthorized methods;
  • Impersonate another person or falsely represent your identity;
  • Use another person’s payment method without authorization;
  • Sell, purchase, or transfer accounts, items, or virtual currency outside systems expressly approved by Egg Injections;
  • Disrupt servers or other users’ ability to access the Services;
  • Introduce malicious code;
  • Scrape or automatically access the Services in an abusive or unauthorized manner; or
  • Use the Services for fraud, harassment, illegal activity, or other conduct prohibited by rules applicable to a particular Service.

We may investigate suspected violations and take appropriate action.

5. Game Updates and Changes

Online games evolve over time.

We may update, rebalance, modify, add, or remove gameplay mechanics, maps, characters, rewards, features, events, items, progression systems, or other game content.

We may temporarily interrupt Services for maintenance, security, updates, technical problems, or other operational reasons.

We do not guarantee that a particular game feature, mode, item, character, event, reward, or Service will always remain available.

Where applicable consumer law gives you rights concerning purchased digital content or material changes to a paid Service, those rights are not waived by this section.

6. Virtual Currency and Virtual Items

Some Services may allow you to purchase or earn virtual currency, virtual items, or other digital benefits.

Unless expressly stated otherwise at the time they are offered:

  • Virtual currency and virtual items exist only within the applicable Service;
  • They are licensed digital features rather than real-world currency or property;
  • They have no cash value outside the applicable Service;
  • They cannot be redeemed for cash from Egg Injections;
  • They may not be sold, transferred, or exchanged outside systems expressly authorized by Egg Injections; and
  • Purchasing virtual currency does not transfer ownership of the underlying game or intellectual property.

Purchased, earned, promotional, or subscription-based virtual currency may be treated differently. Any material restrictions or expiration applicable to a particular type of virtual currency will be disclosed where appropriate.

We may correct balances resulting from errors, duplicate grants, fraud, refunds, chargebacks, exploits, or unauthorized transactions.

If a transaction is refunded or reversed, digital content, virtual currency, or benefits associated with that transaction may be removed from the applicable account.

Nothing in this section limits refund or consumer rights that cannot legally be waived.

7. Purchases and Xsolla

Certain purchases for our Services may be sold and processed through Xsolla, which may act as the merchant of record.

When Xsolla is the merchant of record, Xsolla is responsible for functions associated with the transaction that may include payment processing, payment-method support, applicable taxes, fraud prevention, and chargeback processing.

Your transaction may also be subject to Xsolla’s applicable customer terms, privacy policy, refund policy, and other terms presented during checkout.

Egg Injections remains responsible for operating its games and for matters involving the gameplay experience, game accounts, and delivery or recognition of in-game entitlements under our control.

Prices, currencies, taxes, payment methods, and any other transaction-specific information will be shown during the purchase process.

You represent that you are authorized to use the payment method used for a purchase and that information supplied in connection with the transaction is accurate.

8. Subscriptions and Automatic Renewal

Some Services may offer paid subscriptions.

The applicable purchase screen or checkout will identify the subscription’s:

  • Price;
  • Billing currency;
  • Billing interval;
  • Included benefits;
  • Any trial or introductory period;
  • Automatic-renewal terms; and
  • Other material purchase terms.

Unless the purchase screen expressly states otherwise, recurring subscriptions automatically renew at the applicable subscription rate until canceled.

By purchasing an automatically renewing subscription, you authorize the merchant of record or applicable payment provider to charge the payment method associated with the subscription on a recurring basis according to the terms disclosed at purchase.

You may cancel or disable automatic renewal using the subscription-management method made available for the transaction, including applicable Xsolla subscription-management or customer-support tools.

Unless otherwise disclosed, canceling automatic renewal generally prevents future renewal charges while allowing access to the subscription through the remainder of the already-paid subscription period.

You should cancel before the next renewal date shown for your subscription if you do not want another recurring charge.

Deleting an Egg Account and canceling a subscription are separate actions unless we expressly state that the deletion process will also cancel the applicable subscription. Before deleting an account with an active subscription, users should confirm the subscription’s cancellation status.

We may change subscription prices or benefits prospectively. Where notice or additional consent is required by law, we will provide it.

9. Refunds, Reversals, and Chargebacks

Purchases processed by Xsolla are subject to the refund rules applicable to the transaction and to mandatory consumer rights under applicable law.

Eligibility for a refund may depend on the type of product, whether virtual currency or digital content has been redeemed or consumed, the reason for the request, the date of purchase, applicable law, and the refund policy presented for the transaction.

For payment-processing or billing questions, users may be directed to Xsolla or the applicable payment provider.

For problems involving delivery of game content, game functionality, or account entitlements controlled by Egg Injections, users may contact Egg Injections.

If a payment is refunded, reversed, canceled, disputed, or charged back, we may remove the corresponding subscription time, virtual currency, virtual items, or other digital benefits from the applicable Egg Account.

We may investigate suspected fraudulent chargebacks or payment abuse and take appropriate action.

Nothing in these Terms eliminates refund, warranty, or digital-content rights that cannot lawfully be waived.

10. Advertising

Some Services may be supported in whole or in part by advertising.

Advertising may be provided by Google AdSense or other advertising partners.

Whether advertisements are personalized, contextual, non-personalized, or subject to restricted data processing may depend on your location, age treatment, privacy choices, and applicable law.

Our Privacy Policy provides additional information about advertising-related data practices and privacy choices.

If we sell a subscription or other product described as removing advertising, the offer presented at purchase will determine which advertisements or placements are included. Unless expressly stated, an “ad-free” benefit does not necessarily apply to advertising or promotions outside the applicable game or Service.

11. User Content and Social Features

Some current or future Services may allow users to create usernames, profiles, messages, posts, reports, uploads, or other content (“User Content”).

You retain whatever ownership rights you otherwise have in your User Content.

By submitting User Content to a Service, you grant Egg Injections a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, transmit, moderate, and otherwise use that content to the extent reasonably necessary to operate, secure, improve, and provide the applicable Service.

You represent that you have the rights necessary to submit your User Content.

You may not use social or communication features to post illegal content, threaten or harass others, impersonate others, distribute malware, engage in scams, or violate the rights of another person.

We may remove content or restrict social features where reasonably necessary to enforce these Terms, protect users, comply with law, or protect the Services.

12. Suspension and Termination

We may warn, restrict, suspend, or terminate access to an Egg Account or particular Service if we reasonably believe that:

  • These Terms or applicable game rules have been materially violated;
  • The account is involved in fraud, cheating, abuse, unauthorized transactions, or security threats;
  • Action is necessary to protect other users or the Services;
  • We are required to do so by law; or
  • Continued access presents a material operational or security risk.

Where appropriate, restrictions may apply only to a particular game or feature rather than every Service associated with the Egg Account.

We may temporarily lock an account while investigating suspected compromise or unauthorized activity.

If your Egg Account is terminated, you may lose access to game progress, virtual currency, virtual items, subscription benefits, and other account-associated content, subject to applicable law.

Termination does not eliminate rights or obligations that accrued before termination.

Where reasonably possible and legally appropriate, we may provide information about how to contact us regarding an account restriction.

13. Account Deletion

You may request deletion of your Egg Account through account tools made available by us or by contacting us.

Deleting an Egg Account may permanently remove or make inaccessible data and content associated with multiple games.

You are responsible for reviewing active subscriptions and other account consequences before requesting deletion.

Deletion of an account does not create a right to a refund except where required by applicable law or an applicable refund policy.

Certain transaction, security, enforcement, dispute, or legal records may be retained as described in our Privacy Policy.

14. Intellectual Property

Except for User Content and material expressly identified as belonging to another party, the Services and their content—including software, game systems, text, graphics, designs, artwork, characters, logos, trademarks, audio, interfaces, and other materials—are owned by or licensed to Egg Injections LLC and are protected by applicable intellectual-property laws.

“Egg Injections,” the Egg Injections branding, and associated logos and artwork may not be used in a way that suggests endorsement, affiliation, or ownership without authorization.

Nothing in these Terms transfers ownership of Egg Injections intellectual property to you.

15. Privacy

Our Privacy Policy explains how we collect, use, disclose, and retain personal information.

The Privacy Policy is a disclosure of our privacy practices. References to the Privacy Policy in these Terms do not replace any separate consent required by applicable privacy law for optional processing such as certain advertising, cookies, or marketing.

16. Third-Party Services

The Services may interact with third-party websites or services, including payment, hosting, advertising, authentication, or other technology providers.

Third-party services may be subject to their own terms and privacy policies.

Egg Injections does not control independent third-party services and is not responsible for their operation except to the extent responsibility cannot lawfully be excluded.

17. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

WE DO NOT GUARANTEE THAT THE SERVICES WILL ALWAYS BE AVAILABLE, UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF DEFECTS.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM IMPLIED WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

THIS SECTION DOES NOT EXCLUDE WARRANTIES OR CONSUMER RIGHTS THAT CANNOT LEGALLY BE EXCLUDED.

18. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, EGG INJECTIONS LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO THE SERVICES.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY FOR CLAIMS ARISING OUT OF OR RELATING TO A PARTICULAR SERVICE WILL NOT EXCEED THE GREATER OF:

  1. US $100; OR
  2. THE AMOUNT YOU PAID FOR THE APPLICABLE SERVICE, WHETHER DIRECTLY OR THROUGH OUR MERCHANT OF RECORD, DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT LEGALLY BE LIMITED OR EXCLUDED.

Some jurisdictions provide rights that override contractual limitations. In those jurisdictions, these Terms apply only to the maximum extent permitted by law.

19. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Egg Injections LLC and its members, managers, employees, contractors, and agents from claims arising from your unlawful use of the Services, your material violation of these Terms, or your infringement of another person’s rights.

This obligation does not apply to the extent a claim results from Egg Injections’ own unlawful conduct or where indemnification cannot lawfully be required.

20. Changes to the Services or These Terms

We may update these Terms as our Services, business, or legal obligations change.

When we make changes, we will update the “Last updated” date.

For material changes, we may provide additional notice where appropriate or legally required.

Where applicable law requires additional consent to a change, continued use alone will not replace that required consent.

If you do not agree to revised Terms, you may stop using the Services and may close your Egg Account subject to outstanding transactions, subscriptions, and applicable legal obligations.

21. Discontinuation of a Service

We may discontinue a game, feature, or Service.

If we discontinue a paid Service, we will address active subscriptions, future renewals, and outstanding paid benefits in accordance with applicable law and the terms applicable to those purchases.

Discontinuation of one game does not necessarily require termination of your Egg Account or other games associated with it.

22. Governing Law

These Terms are governed by the laws of the State of Arkansas, United States, without regard to conflict-of-law principles, except to the extent mandatory consumer law in your place of residence provides otherwise.

Subject to mandatory law applicable to you, legal proceedings arising from these Terms may be brought in the state courts located in Saline County, Arkansas, or the United States federal court having jurisdiction over Saline County, Arkansas.

Nothing in this section deprives a consumer of protections or forums that applicable law does not permit the parties to waive.

23. Severability

If a provision of these Terms is determined to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in effect.

24. No Waiver

If we do not immediately enforce a provision of these Terms, that does not waive our right to enforce it later.

25. Entire Agreement

These Terms, together with our Privacy Policy, applicable purchase terms, and other policies or rules expressly incorporated into these Terms, constitute the agreement between you and Egg Injections concerning the Services covered by them.

Transaction-specific terms presented during checkout may also apply to individual purchases.
